A divided federal appeals court has just handed President Trump, Elon Musk and DOGE a huge victory.
The court overturned a lower court ruling that had blocked the government downsizing team from accessing sensitive data from the Treasury Department, Education Department, and the Office of Personnel Management.
In a 2-1 decision, the 4th U.S. Circuit Court of Appeals lifted a stay previously issued by a federal judge in Maryland against the Department of Government Efficiency.
Separately, the court declined, by an 8-7 vote, to rehear the case en banc, meaning it will not be reviewed by the full panel of active judges.
The decision totally makes sense and is in line with the Constitution..
Either the President of the United States, who leads the executive branch, has access to the data in said branch or he does not.
Either the president is in charge or the bureaucrats and lower court judges are.
